WHEREAS, the Board of Directors of the Reeds Crossing Condominium Association is empowered by Sections 3.2L and 7.3 of the Declarations of the Reeds Crossings Condominium and Article 3.1g of the Reeds Crossing Condominium Association Bylaws to Adopt and Amend, from time to time, Rules concerning the use, maintenance, alteration, and improvement of the Property, Common Area, Limited Common Area, the Units, and the various parts thereof, as well as Rules concerning the conduct and actions of the Owners, Guest, Invitees, Tenants, and other users of the Condominium;
Now Therefore, the Board of Directors of Reeds Crossing Condominium hereby adopt the following Rules pursuant to the authority conferred on it the management of the Reeds Crossing Condominium, which Rules are in addition to and supplementary of the provisions of the Declaration of the Reeds Crossing Condominium and Reeds Crossing Condominium Association By-Laws
1. ALTERATION
No changes, modifications, alterations, construction or any improvement of any kind shall be permitted to be made to any unit, part of the common area or part of the limited common area at any time without prior written approval from the Board of Directors. If Board approval is obtained, all provisions of RSA 356B and the applicable condominium instruments must be followed at the applicant's own expense prior to undertaking any and such activity. In addition, all local and state building codes and administrative regulations must be strictly adhered to. A town of Sandown Building Permit must be presented to the Board of Directors prior to any construction.
2. LITTER & TRASH
Under no circumstances shall trash and refuse of any kind including, but not limited to, papers, cans, bottles, cigarette butts, food, and all items that may constitute trash or refuse be stored in, placed, kept or left in any part of the Common Areas or any part of the Limited Common Area. There shall be no illegal dumping (ie: computers, televisions sets, paint cans [of any type], or carpets). Only common household trash may be disposed of in designated trash pick up areas.
3. NOISE & NUISANCES
No nuisances shall be allowed on the property, nor is any practice allowed which annoys or interferes with the peaceful possession and use of the property by the unit owners. Everyone is expected to reduce noise levels after 10:00 P.M., so that others are not disturbed. At no time are musical instruments, wind chimes, radios, televisions, barking dogs, and the like to be so loud, as to be a nuisance and prevent others from peacefully enjoying their property. Owners are responsible for their visitor's behavior. All visitors must adhere to the Association Rules and Regulations and applicable Condominium Instruments.
4. PETS
Pets and pet fouling on the Common Area and Limited Common Areas are prohibited and will be considered offensive. Should an accident occur, the owner shall pick up the waste immediately and dispose of it properly. Pets shall not be allowed to create noise or allowed to run loose, or in any way create a disturbance or unpleasantness. Any damage done by a pet will be assessed to the unit owner owning ,possessing, or keeping the pet. Pets are to be leashed by the rear of your unit only. The unit owner may leash a pet from his/her Limited Common Area provided the leash is no longer than ten feet and in a manner so as to prohibit the animal from entering the Limited Common Areas of neighboring Unit Owners. The provisions of this rule are in addition to the provisions of Section 3.2K of the Condominium Declaration. Any violation of this rule will be subject to the fine schedule set forth herein below and shall be in addition to all other enforcement provisions allowed by the Condominium Instruments and applicable Law. All household pets are to be indoors if owners are not at home. Pets are not to roam freely (ie: dog, cat, 20Ibs max) There are no visitor Pets ALLOWED on the property at anytime, under any circumstances. Only a Dog twenty pounds or less are permitted. They are to be leashed pursuant to town ordinance.
5. PARKING
Motor vehicles shall be parked in assigned spaces only. Parking of vehicles in locations other than assigned parking spaces, shall result in the vehicle being towed at the owner's expense. In addition to assessment of fines as herein provided below. Parking on the grass areas or dirt is strictly prohibited. Visitor Parking is on the street. There shall be no parking of guest cars in parking spaces, other than those assigned to the unit owner hosting said guest, unless previous arrangements have been made. Any motor vehicle parked within the Association must be currently registered and inspected. All visitor parking shall be in the street. Any vehicles in violation of this rule shall be towed at the owners expense, in addition to any assessment of fines outlined herein below.
6. ATV/OFF-HIGHWAY RECREATIONAL VEHICLES (OHRV)
ATVs and OHRVs are not permitted on Common Area or Limited Common Areas of Reeds Crossing Condominium, nor can they be stored in the same. Owners of such vehicles shall have thirty (30) days from the effective date of these Rules within which to remove said vehicles. Any vehicle found in violation of this Rule shall be towed at the unit owners expense, in addition to the fines outlined herein below.
7. STORAGE LIMITATIONS
Children's toys, bicycles and related items shall not be stored in any part of the Common Area or Limited Common Areas located in front of units. All such items shall be stored inside units, or in limited common areas assigned to your Unit in the rear of said Unit only. Storage in the common area is prohibited under all circumstances. There shall be no storage of gas cans, petroleum products and other such hazardous material within any part of the common area or limited common area.
8. SPEED LIMIT
The speed limit throughout the Association shall be Five [5] MPH miles per hour at all times.
9. A/C UNITS/WINOOW CLOSURE
All Air Conditioning Units are to be removed from windows and windows are to remain closed during the winter season beginning October 1st of each year, unless modified by the Board of Directors through notice to Unit Owners. It is understood that heating costs are a shared common expense and that failure to remove window air conditioning units and or unreasonably keeping windows open during the winter heating season is wasteful and causes unnecessary and needless expense to the Association as a whole.
10. COMPLAINTS
Complaints and request must be in writing and submitted to the Board of Directors for review at the next Board Meeting.
11. PLOWING
All Unit Owners are required to move ,vehicles with an accumulation of three (3) or more inches of snow, in order to facilitate snow plowing.
12. FIRE PITS
No fire pits shall be allowed within the common areas of the Association under any circumstances.
13. FEES
Monthly Assessments are due on the 1st of every month. If monthly assessments are not received by the 7th of the same month, a fifty dollar ($50.00) late fee shall be assessed and shall become a lien against the unit in accordance with RSA 356-B and the applicable Condominium Instruments. Weekends and Holidays are no exception to the seven day grace period herein.
14. KEYS
All units are required to have a copy made for the Association in case of an emergency. Keys are kept in a safe, secure area
15. OTHER GENERAL RULES / AMENDMENTS
The Board may make rules from time to time concerning the use, maintenance, alteration, improvement, and management of the Condominium including, but not limited to rules and regulations concerning: the assessment and collection of payment responsibilities, use of amenities, signs, public view restrictions, refuse, pets, nuisance, and restricting nuisance [including noise and light restrictions], recreational equipment, vehicles, storage, Common Area use, outside activities, roads and driveways, units, limited common area use, guest, tenants, invitees, violations and enforcement penalties, fines, maintenance requirement of owners, and parking. Prior to being effective, all owners shall receive notice of any new amended rules through the Association newsletter, mailings, or other forms of communication to the owners from the Board of the Association Manager. The Board may by rule impose reasonable fines or monetary penalties fur violation of said rules. Any such fine or penalty shall be a lien upon the affected unit, which lien may be perfected and enforced in accordance with RSA 356:B:46, or other relevant provisions of the Condominium Art, as it may be amended from time to time.
16. NOTICES
Any unit owner or person who refuses to accept or claim mailed or served notice or who frustrates attempts by the Association or its duly authorized agents, to give any notice contemplated or desirable pursuant to these Rule, by failing to give or leaving a forwarding address, or by other act of omission, shall be deemed to be notified of the consent of the notice which was attempted to be given, provided the party giving such notice has caused current mailing address and/or phone number given by the owner to the Association or its duly authorized agent.
17. DRIVEWAY (FIRELANE)
The Association driveway up to building 4 is designated as a fire lane and shall be strictly used only as a drop off point by OWNERS. Visitors use of the designated fire lane is strictly prohibited. Owners shall have a 10 minute maximum to unload their vehicle (ie: groceries, household items etc) Any vehicle found in violation of this rule shall be towed at owners expense and shall be subject to the fine set forth herein, as well as all other penalties allowed under the applicable Condominium instruments.
18. FINES
Any violation of these Rules and Regulations and any provision of the Declaration or By-Laws of Reeds Crossing Condominium shall be subject to the following fine schedule:
1st Offense: $50.00
2nd Offense: $100.00
All Violations After 2nd Offense : $100.00
Fines shall be in addition to all other remedies authorized by these Rules and the Declaration and By-Laws.
These Rules are Unanimously Approved and Adopted this 7th day of July 2009 by the Board of Directors of the Reeds Crossing Condominium Association.
